Are electric dirt bikes street legal?

No. Federal law only treats a vehicle as a street motorcycle if it was manufactured for use on public roads and built to Federal Motor Vehicle Safety Standards. Off-road machines are outside that system entirely — NHTSA does not regulate them and does not issue manufacturer codes for them, which is why the number stamped on the frame is a serial number and not a VIN.

Do you need a licence or registration for an electric dirt bike in Pennsylvania?

Pennsylvania's registration law, 75 Pa.C.S. § 1301, requires any vehicle driven on a highway to be registered, and registration requires a titleable, road-compliant vehicle. An off-road electric dirt bike is neither, so it cannot be registered or titled for road use in Pennsylvania.

Three places. Private property with the owner's permission. Designated motorized trails on DCNR state forest land — Pennsylvania does run motorcycle trail systems, and some are open to unlicensed motorcycles, seasonally.

Stricter, and enforced. Under 75 Pa.C.S. § 3722, added by Act 92 of 2022, it is unlawful to operate a dirt bike on any highway, sidewalk, or bicycle lane in an urban municipality, and Philadelphia is a city of the first class.

Are electric dirt bikes street legal in New Jersey?

No, and New Jersey has a statute written for exactly this machine. N.J.S.A. 39:3C-1 defines a dirt bike as any two-wheeled motorcycle designed and manufactured for off-road use only that does not comply with Federal Motor Vehicle Safety Standards or EPA on-road emissions standards. Because the definition depends on non-compliance, there is no route to registering one for street use.

Where can you legally ride in New Jersey?

Effectively private property with permission. Every New Jersey State Park and Forest is closed to off-road vehicles under N.J.A.C. 7:2-3.4, except for permitted organised special events, and Wildlife Management Areas require a written permit.

A first street offence under N.J.S.A. 39:3C-28 carries a fine of $250 to $500, rising to $500 to $1,000 for repeat offences. N.J.S.A. 39:3C-35 provides for impoundment of not less than seven days on a first offence with a $500 municipal fee plus towing and storage, and not less than fourteen days and $750 after that.

In New Jersey, N.J.S.A. 39:3C-19(a) requires an approved helmet for any rider or passenger on a dirt bike, and the wording carries no location qualifier. N.J.S.A. 39:3C-16 sets the age rules for public land and highway crossings: under 14 may not operate at all, and under 18 must have completed a state-certified safety course and carry the certificate.

Pedals, power and speed — and you need all three to be a bicycle. Federal law, 15 U.S.C. § 2085, defines a low-speed electric bicycle as having fully operable pedals, a motor under 750 watts, and a motor-only top speed under 20 mph.

None of our electric dirt bikes. The 79Bike Lynx, 79Bike Viper S, VALTINSU EM-5 Pro, VALTINSU EM23 and OUXI GT-2000 are all sold as off-road machines and are not street legal in Pennsylvania or New Jersey. The Elvarion V8 has pedals and a bicycle drivetrain, but we have not been able to confirm its motor rating or top speed, so we are not classifying it either way. Ask us before you buy and we will read the spec label with you.
