ATV Laws in Pennsylvania & New Jersey: The 2026 Guide

Complete guide to ATV laws in PA and NJ — registration, helmet rules, age requirements, where you can ride. Updated for 2026. Written by ScooterLand USA Philadelphia.

PA and NJ have very different ATV rules, and most of what people tell you at the trailhead is half right. Here's the actual law as of 2026 — registration, helmets, ages, and where you can legally ride — based on the current PA DCNR and NJ DEP regulations our team confirms with every new buyer.

This isn't legal advice. Always confirm current rules with your state DMV or DCNR/DEP office before riding on public land.

Pennsylvania ATV registration (DCNR)

All ATVs ridden anywhere in PA except on the rider's own private property must be registered with the PA Department of Conservation and Natural Resources (DCNR). Registration is $40 for two years. You'll need a bill of sale or title (we provide both with every ATV purchase), the rider's ID, and the $40 fee. Registration can be done online at the DCNR site or by mail.

Pennsylvania helmet & age rules

Riders under 18 must wear a DOT-approved helmet and eye protection at all times in PA. Riders 16 and 17 can ride a full-size adult ATV with a safety course certificate; riders 12–15 are restricted to ATVs under 90cc; under 8 cannot legally operate an ATV on any public land. A PA driver's license is not required to ride on registered DCNR trails. A motorcycle endorsement is also not required — ATVs are not street-legal in PA.

New Jersey ATV registration (DEP)

NJ requires every ATV to be titled and registered with the state DEP, even for use on private property. Registration runs about $35 annually plus title fees, and the ATV must have a valid VIN. NJ does not have state-owned ATV trails. Riders are limited to private property (with written permission), private off-road parks, or out-of-state public trails.

New Jersey helmet & age rules

All NJ ATV riders, regardless of age, must wear a DOT-approved helmet and eye protection. Riders under 14 must be supervised by an adult; under 12 cannot operate an ATV without direct adult supervision on the same vehicle or alongside. NJ requires riders under 16 to complete a state-approved ATV safety course before riding on any public or private property other than their own residence.

Where you can legally ride

PA: 270+ miles of state-registered ATV trails across Bald Eagle State Forest, Rock Run, Whiskey Springs, and several DCNR off-road riding areas. Trail passes are included with DCNR registration. NJ: No state-managed ATV trails. Closest public-trail options are private parks like Englishtown Off-Road Park, or crossing into PA / NY for state-trail access.

A practical check before choosing an ATV

Choose your permitted riding location before you choose the machine. Ask the landowner or venue whether ATVs are accepted, what documents they require and whether current restrictions apply. Permission for one location is not permission for another. Keep road use, trail access and private-property permission separate when you ask questions, and confirm current requirements with the responsible state agency rather than relying only on this guide. Check the specific machine's manufacturer rider-age label and the site's ATV size-guide guidance. Fit, control reach and rider experience matter, but they do not override published age guidance. Do not treat a marketing name or engine size as proof that an ATV is suitable for a child. Where a manufacturer label is absent from the catalogue, check the machine's label in store before buying.
