Are Electric Dirt Bikes Street Legal in Pennsylvania & New Jersey? A 2026 Buyer Guide

What Pennsylvania and New Jersey actually say about riding 72V electric dirt bikes like the 79Bike Falcon and Lynx — OHV titling, helmet rules and where you can legally ride.

Are Electric Dirt Bikes Street Legal in Pennsylvania & New Jersey? A 2026 Buyer Guide

Every week someone walks into our Philadelphia showroom asking the same question: "Can I ride a 79Bike Falcon Pro on the street?" The honest answer is "it depends on the state, the road, and how the bike is registered." Here's a plain-English 2026 guide for PA and NJ riders.

The short answer

High-power electric dirt bikes (the 72V Falcon Pro, Falcon GT, Lynx, and the 60V Viper S) are sold as off-highway vehicles (OHVs). They do not have DOT lighting, mirrors, or turn signals from the factory, which means they cannot be registered as street motorcycles in PA or NJ as-is.

Pennsylvania OHV rules

  • Off-highway motorcycles must be titled and have an OHV registration through PennDOT.
  • Riders under 16 must complete an ATV/OHV safety course.
  • Helmets are required for all riders regardless of age.
  • Legal riding areas include DCNR-designated trails (Rock Run, Bloody Skillet, Whiskey Springs), private land with permission, and licensed OHV parks.

New Jersey OHV rules

  • NJ requires off-road motorcycle registration through the MVC.
  • Riding on public roads, sidewalks or state-owned land without permission is prohibited.
  • Legal options are private land with written permission and a handful of licensed off-road parks.

What about e-bike classifications (Class 1/2/3)?

The Class 1/2/3 e-bike framework is for pedal-equipped bicycles capped at 750W and 28 mph. The 79Bike Falcon Pro, Falcon GT, Viper S and Lynx all exceed those limits — they are electric motorcycles, not Class 3 e-bikes, and they cannot use bike lanes or multi-use paths.
